These Terms govern your use of the Stolen Cellar website and any orders placed through it.
Stolen Cellar is operated by Stolen Cellars Limited, a New Zealand company. In these Terms, “Stolen Cellar”, “we”, “us” and “our” refer to Stolen Cellars Limited.
Your use of the website is subject to these Terms. By placing an order, you confirm that you have read and agree to them.
1. About Stolen Cellar
Stolen Cellar is an online wine retailer. We work directly with wineries, importers and distributors, who may pick, pack and dispatch products directly to you from their own premises.
We do not hold all products in a central warehouse. This means that products within one order may be supplied by different partners and may arrive separately.
Unless we expressly state otherwise, Stolen Cellar is your point of contact for your order, including order queries, delivery issues, refunds and consumer rights.
2. Alcohol and Age Requirements
You must be 18 years of age or over to purchase alcohol from Stolen Cellar.
By entering our website and again when completing an alcohol purchase, you confirm that:
1. you are at least 18 years old; and
2. any person receiving the order is also at least 18 years old.
We may request proof of age before accepting or fulfilling an order. We may cancel and refund an order where we cannot reasonably verify that the purchaser or intended recipient is 18 years of age or over.
Alcohol must not be purchased for, or supplied to, anyone under 18 years of age.
Our delivery partners may request approved proof of age at delivery. They may refuse to hand over an order where they are not satisfied that the recipient is aged 18 or over, or where delivery would otherwise breach the law or their delivery requirements.
3. Orders and Acceptance
Products displayed on our website are an invitation for you to place an order, not an offer by us to sell.
When you place an order, you will receive an automated confirmation email acknowledging that we have received it. This email does not mean that we have accepted your order.
Your order is accepted when we send you a dispatch confirmation, or otherwise expressly confirm acceptance.
We may decline, cancel or refund an order where:
- a product is unavailable;
- there has been an obvious pricing, product description or website error;
- we cannot verify age or payment details;
- delivery is not possible;
- we reasonably suspect fraud, misuse, resale or unlawful activity; or
- we are otherwise required to do so by law.
If we cancel an order after payment has been taken, we will provide a refund for the affected products.
4. Product Availability and Supplier Fulfilment
All products are subject to availability.
Because our products are supplied directly by wineries, importers and distributors, stock can occasionally sell out or become unavailable before an order is accepted or fulfilled.
Where a product is unavailable, we may:
- contact you to offer an alternative;
- remove the unavailable item and fulfil the balance of your order; or
- cancel and refund the unavailable item.
We will not substitute a different wine, vintage or product without your approval.
Wine labels, vintages, packaging and bottle images may change from time to time. We will make reasonable efforts to keep product information current, but minor differences between website imagery and the delivered product may occur.
5. Pricing and Payment
All prices are displayed in New Zealand dollars and include GST unless stated otherwise.
Delivery charges, where applicable, will be shown at checkout before you complete your purchase.
We may change prices, promotions and product availability at any time. Price changes will not affect orders we have already accepted, except where there has been an obvious pricing error.
If a price or product detail has been incorrectly displayed, we may cancel the affected order and provide a full refund.
Payment must be made using one of the payment methods available at checkout. You confirm that you are authorised to use the selected payment method.
5.5. Comparison pricing
Some products may display an “Elsewhere” price or an “RRP” for comparison purposes.
“Elsewhere” refers to a price identified by us at another New Zealand retailer for the same product. “RRP” refers to the recommended retail price supplied by the winery, producer, importer or distributor.
Comparison prices are displayed on a per-bottle basis. Any case saving shown is calculated by comparing the full Stolen Cellar case price with the displayed comparison price multiplied by the number of bottles in the case.
Retail prices, recommended retail prices, promotions and product availability may change over time. Comparison prices are reviewed periodically and are intended to provide a useful pricing comparison at the time they are recorded. An RRP is a recommended price only and may not be the price charged by every retailer.
6. Delivery
We currently deliver within New Zealand only.
Orders may be dispatched by one or more wineries, importers, distributors or courier partners. As a result, products within the same order may arrive in separate deliveries and at different times.
Any delivery estimate provided by us is an estimate only. Delivery times may be affected by supplier processing times, courier capacity, weather events, public holidays, rural delivery, incorrect address details or other circumstances outside our reasonable control.
You are responsible for providing an accurate delivery address and ensuring that an adult aged 18 or over is available to receive alcohol where required.
If an order is returned to a supplier or courier because it could not be delivered, we may charge reasonable redelivery or return costs before resending it.
7. Cancellations and Changes
Please contact us as soon as possible if you need to change or cancel an order.
Because orders may be sent directly to suppliers for fulfilment shortly after being placed, we cannot guarantee that changes or cancellations can be made once an order has been accepted or sent for dispatch.
We are not required to provide a refund where you have changed your mind, selected the wrong product, or no longer want the order, except where we agree otherwise or where required by law.
8. Returns, Damaged Products and Consumer Rights
Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or any other applicable New Zealand law.
If your order arrives damaged, incorrect, incomplete or faulty, please contact us promptly with your order number and, where possible, photographs of the issue.
For products that may be faulty, including wine that appears spoiled or corked, please retain the bottle, contents, closure and any relevant packaging until we have reviewed the issue.
Where a product does not meet the guarantees required by New Zealand consumer law, we will provide an appropriate remedy, which may include replacement, refund or another remedy available by law.
9. Promotions, Discount Codes and Member Offers
Promotions, discount codes and member offers are subject to any specific terms displayed with the offer.
Unless stated otherwise:
- discount codes are not redeemable for cash;
- promotions apply only during the stated period and while stock is available;
- promotions may exclude selected products, delivery charges or gift cards; and
- we may cancel or withdraw an offer where there has been an error, misuse, fraud or breach of these Terms.
We may change or end a promotion at any time, provided this does not affect orders already accepted under that promotion.
10. Gift Cards
This clause applies where Stolen Cellar sells gift cards or e-gift cards.
Gift cards:
- are redeemable only through the Stolen Cellar website;
- cannot be exchanged for cash except where required by law;
- cannot be used to purchase other gift cards;
- are valid for three years from the date of issue, unless a longer period is stated;
- are the responsibility of the holder and should be kept secure.
We are not responsible for lost, stolen, damaged or misused gift cards, except where required by law.
If you return a product purchased using a gift card, any refund may be issued as store credit or reissued to the original gift card, where permitted by law.
11. Marketing Communications
We will send you transactional communications necessary to process, fulfil and support your order.
We will send marketing emails only where you have opted in, consented, or where otherwise permitted by law. You can unsubscribe from marketing emails at any time using the unsubscribe link in the email or by contacting us.
Unsubscribing from marketing communications will not stop essential service messages relating to orders, payments, deliveries, product recalls or account administration.
12. Privacy
We collect, use and store personal information in accordance with our Privacy Policy.
To process and fulfil your order, we may share relevant information, including your name, address, contact details and order details, with our suppliers, fulfilment partners, couriers, payment providers and technology providers.
Our Privacy Policy explains how we collect, use, store and disclose personal information, and how you can request access to or correction of your personal information.
13. Website Accuracy and Availability
We take reasonable care to ensure that information on our website is accurate and current. However, we do not guarantee that all information, including product descriptions, images, vintages, pricing and availability, will always be complete, accurate or current.
We may update, modify, suspend or remove any part of the website at any time.
We are not responsible for any loss arising from temporary website unavailability, technical issues, third-party services or events outside our reasonable control.
14. Liability
To the maximum extent permitted by law, we are not liable for indirect, consequential or special loss, including loss of profits, loss of opportunity or loss arising from delayed delivery.
Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or any other law that cannot lawfully be excluded.
15. Changes to These Terms
We may update these Terms from time to time by publishing the revised version on our website.
The version in force at the time you place an order will apply to that order, unless a change is required by law or is made for your benefit.
16. Governing Law
These Terms are governed by the laws of New Zealand.
Any dispute arising in connection with these Terms, the website or an order will be subject to the laws and courts of New Zealand.
